n Canada, it is possible to be criminally charged for transmitting a sexually transmitted disease (STD) knowingly. Depending on the circumstances, such an act could be prosecuted as an assault or sexual assault.
Section 265 of the Canadian Criminal Code defines assault as intentionally applying force to another person without their consent. If an STD is transmitted as a result of this kind of assault, the offender may face criminal charges. Similarly, if someone transmits an STD to another person without their consent and that person experiences sexual activity without their consent, then the offender may face charges of sexual assault.
